Acceptable Use Policy

Effective Date: December 14, 2021

This website and the features, functionalities, applications, browser extensions and other services
available through this website (collectively, the “Service”) are provided by Districts Mutual Insurance
and Risk Management Services (“us”, “we”, or “our”). This Acceptable Use Policy (“AUP”), in addition
to any additional terms and conditions, agreements, policies, and additional terms applicable to your
access to or use of the Service, including, without limitation, any agreement between us and the
college on whose behalf you access or use the Service (collectively, the “Agreements”), govern your
access to and use of the Service.

REVIEW THIS AUP CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO
BE BOUND BY THIS AUP. IF YOU DO NOT AGREE WITH THIS AUP, YOU ARE NOT
PERMITTED TO ACCESS OR USE THE SERVICE.

Without limiting anything set forth in the applicable Agreement, your access to and use of the
Service must comply with the following:

  1. You are only allowed to use the Service for its intended purposes, as determined by us in our sole, but reasonable, discretion. Without limitation, you are not permitted to access or use the Service to: (a) publish, post, distribute, or disseminate any content which is or could reasonably be viewed as: (1) hate speech, obscene, harassing, threatening, pornographic, abusive, or defamatory to an individual or group of individuals on the basis of religious belief, race, gender, age, disability, or otherwise; (2) inciting violence, or containing nudity or graphic or gratuitous violence; (3) an unauthorized commercial communication of any kind (including, without limitation, spam); (4) fraudulent, inaccurate, or misleading, or otherwise objectionable content of any kind; (5) infringing or violating someone else’s rights or otherwise violating the law; or (6) identifying any person without their consent or disclosing anyone else’s personal contact details or invading their privacy; (b) violate any laws; (c) transmit or upload any software or other materials that contain any viruses, worms, trojan horses, defects, time bombs, or other items of a destructive nature; or (d) engage in commercial activity except as, and solely to the extent, permitted under the applicable Agreements.
  2. You are also prohibited from: (a) reformatting or framing any portion of the Service, except as otherwise permitted under the applicable Agreements; (b) using any device, software, or procedure that interferes with, or attempts to interfere with, the normal operation of the Service; (c) taking any action that imposes, or may impose, in our sole, but reasonable, discretion, an unreasonable or disproportionately large load on our information technology infrastructure; (d) modifying, adapting, translating, or reverse engineering any portion of the Service; (e) disrupting or otherwise interfering with the Service or the networks or servers we use; (f) impersonating any person or entity or misrepresenting your connection or affiliation with a person or entity; (g) creating a false identity on or through the Service; (h) creating an account on the Service for anyone else (except when, and only to the extent, you create one or more sub-accounts on the Service for your employees or other representatives that are authorized to access or use the Service on your behalf; (i) collecting or storing, or attempting to collect or store, information about other users of the Service, except as, and solely to the extent, permitted under the applicable Agreements; or (k) engaging in any activity that is illegal under federal, state, or other local laws.
  3. You shall not release to any third party information related to your access to or use of the Service for purposes of monitoring the Service’s availability, performance, or functionality, or for any other benchmarking or competitive purposes without our prior written approval.
  4. You must: (a) use the Service for your, or the college on whose behalf you are authorized to access or use the Service’s, own business purposes; (b) provide accurate information to us pertaining to your account, and any employee or representative authorized to access or use the Service on your behalf and keep such information up to date, including, without limitation, your personal information; and (c) access and use the Service in a professional manner.
